Eastside Fire & Rescue adopted Resolution 96-11 for the purpose of regulation burning within the boundaries of the District. This permit process does not apply to the area of the Fire District under contract with the Department of Natural Resources.
The guidelines below will be followed for issuing burning permits for residential, recreational, religious, ceremonial, and land clearing outdoor fires.
1) RESIDENTIAL FIRES: Burning is permitted when there is a minimum separation of 50 feet from any structure or combustible material. The parcel is outside the Urban Growth Areas as defined by Washington State RCW. 36.70.A.030 for Snohomish, King, and Pierce Counties. Fires shall consist solely of natural vegetation in accordance with Article 8 of the Puget Sound Clean Air Agency (PSCLEANAIR) regulations. This permit allows for one burn pile only.
2) COOKING/RECREATIONAL FIRES: Fires in manufactured cooking devices do not require a permit. Cooking/Recreational fires in an open pit shall be prepared to provide an area that is free of materials that could allow the fire to spread. Fires shall not be larger than 3 feet by 3 feet by 2 feet and shall have a minimum separation of 24 feet to any structure of combustible material. Fires shall consist solely of charcoal or seasoned natural wood. This permit authorizes one such fire at a time.
3) NATIVE AMERICAN RELIGIOUS/CEREMONIAL FIRES: Fires shall be prepared to provide an area that is free of material that could allow the fire to spread and shall not be larger than 3 feet by 3 feet by 2 feed and shall have a minimum separation of 25 feet from any structure or combustible material. This permit authorizes one such fire at a time.
4) LAND CLEARING FIRES: Land clearing fires are permitted provided the parcel is outside the Urban Growth Areas, the material to be burned is from that site only, the pile is no larger than fifty (50) feet in diameter, and is located at least 150 feet from any other combustible material. A person at least 18 years of age, who is qualified to operate on-site machinery, must be in attendance at the permitted location with proper equipment available to control and extinguish the fire at all times.
Authorized burning times are established by Puget Sound Clean Air Agency (PSCAA). Watch and listen for changed in these times in the news media. Recorded burn informationis available 24 hours a day at 343-8800 or (800) 595-4341. Fires shall not be allowed during any stage of an air pollution episode or any imposed burn ban.
A seasonal moratorium will be imposed on residential and land clear fires from June 15 through September 30th of each year.
An inspection and a fee of $100.00 is required for a Land Clear burn permit. A land clear burn permit is valid for one (1) construction site or development, and no longer than one year from date of issue. During the Land Clear permit inspection, if it is determined that the site does not meet the requirements of King County Fire Protection Eastside Fire & Rescue Resolution 95-13 (which has been repealed by Resolution 96-11) , the Land Clear permit fee is not refundable. If there is an error on the part of the District if District personnel, the application fee is refundable.
A permit shall be required for Residential, Cooking, and Religious/Ceremonial fires, but a fee and site inspection is not required. The permit is valid until the 15th of June of each calendar year regardless of the date of issue.

b) At the time of the application for a Land Clear permit, a fee of $100.00 is required. A check or money order for the correct amount is preferred, but cash is acceptable. The fee shall be collected at the station that issued the permit.
c) A physical inspection of the site will be conducted for the Land Clear application by a fire department official. If the burn site meets the requirements of the permit, it will be issued by the fire official making the inspection. The permit is valid for the specific site only and is not transferable by the applicant. Land Clear burn permit applications will be processed within 48 hours of receipt at any of the fire stations listed above.
d) A permit issued for a specific purpose cannot be used for any other purpose (e.g., a permit issued for a cooking fire cannot be used for residential burning, a land clear permit cannot be used for a residential fire, etc.).
Permits in violation of any of the standards set forth in the King County Fire Protection Eastside Fire & Rescue Resolution 95-13, or articles of the Uniform Fire Protection Code, or PSCLEANAIR regulations, will be revoked.
